These Terms and Conditions (“Terms”) govern the facilitation and distribution of White Goods as rewards to the eligible Winner(s) of the Junglee Ludo Tournament (“Tournament”) organized by Junglee Games India Pvt. Ltd. (“Company”) on its Junglee Ludo platform (“Platform”). The Tournament is conducted as a Free-to-Play Tournament wherein White Goods would be given as rewards based on a User’s performance. There is no cash, money, or other stake required from any User to participate in these Free-to-Play Tournaments.
These Terms are to be read in conjunction with, and are subject to, the general Terms of Service, Privacy Policy, and other terms and policies of the Platform and Tournament specific terms and conditions, which shall continue to apply. In the event of a conflict, these Terms shall prevail solely with respect to the White Goods reward facilitation.
Participation in these Free-to-Play Tournaments is strictly limited to users who are 18 years of age or above. As part of the rewards, the Company will conduct KYC verification to validate age and identity before disbursing any White Goods rewards. In the event it is found that a participant is under 18 years of age, the Company reserves the right, at its sole discretion, to revoke, cancel, or withhold the reward without any further liability.
All trademarks, logos, and brand names of the White Goods are the property of their respective owners. Their use in the Platform is solely for identification of the products being offered as rewards and does not imply any commercial relationship, endorsement, sponsorship, or affiliation.
By participating in the Tournament, the User, including the Winner(s), agree to be bound by these Terms.
1. Definitions
For the purposes of these Terms, the following terms shall have the meanings assigned to them below:
- “Company” or “Junglee Games” refers to Junglee Games India Pvt. Ltd.
- “Dealer(s)” refers to a third-party seller(s), vendor(s), or supplier(s) responsible for the sale, delivery or fulfillment of the White Goods.
- “Free to Play Tournament” refers to a type of Tournament in which users can register and participate without any monetary cost/entry fee (no deposit,, or other stake or hidden charge).
- “TDS” refers to tax deducted at source, being the statutory/mandatory tax withholding applicable on the cost/invoice value of White Goods, as per provisions of the Income Tax Act, 1961.
- "User" refers to any individual who accesses the Platform by any means.
- “White Goods” means tangible goods offered as rewards under the Tournament, which may include (but not limited to) automobiles, electronic goods, or appliances offered (e.g., bikes, televisions, refrigerators, smartphones, etc.).
- “Winner”means a User who participates in the Free-to-Play Tournament and is declared eligible to receive White Goods as a reward.
2. Reward Notification and Selection.
- Notification of Winner(s): Upon conclusion of the Free-to-Play Tournament, Winner(s) will be notified by Company via push notifications, SMS and/or WhatsApp along with an electronic form (in-game document) outlining the next steps (“Notification”).
3. Winner’s Obligations
- Providing Consent and Delivery Information: Upon winning White Goods as the reward, Winner(s) are required to submit a valid delivery address and contact number, through the provided form, within fifteen (15) days from the date of first Notification.
- Payment of TDS: Tax Deduction at Source (“TDS”) shall apply to the White Goods under these Terms under the Income Tax Act, 1961 [at the rate of 30% (or other rate as may be applicable)]. The same will be borne and discharged by the Company on behalf of the Winner.
- Reminders: The Platform may, at its discretion, issue reminders to Winner(s) via push notifications, SMS and/or WhatsApp, at regular intervals during the aforementioned fifteen (15) day period. However, the responsibility for compliance remains solely with the Winner(s), and failure to act within the timeframe shall not be excused on the grounds of non-receipt of such repeated reminders.
4. Delivery and Product Fulfillment
- Ownership and Invoicing: Title of and risk in the White Goods shall transfer from the Dealer to the Winner upon delivery. The Company shall not be construed as the seller of the White Goods. The sale invoice shall be issued in the name of the Winner, with the Company indicated as a “care-of” party solely for the purpose of facilitating payment to the Dealer by the Company for the Winner. Upon payment to the Dealer, the Company shall be deemed to have fully discharged its obligations.
- Warranty and Post-Sale Support: All warranty, servicing, or post-sale obligations, including but not limited to warranty claims, product malfunctions, rest solely with the Dealer and/or the manufacturer of White Goods. The Winner shall be required to directly contact the Dealer and/or manufacturer for any such support.
- Additional Charges: Any additional charges or statutory dues, such as insurance, installation, road tax, registration or similar required for the registration of White Goods, must be borne solely by the Winner. The insurance policy and tax documents will be issued in the Winner’s name.
- Delivery Timelines and Communication: The Company will instruct the Dealer to deliver the White Goods within 15 days from the receipt of Winner’s consent and TDS payment, subject to stock availability. Delivery status updates will be communicated via SMS/WhatsApp.
5. Role of Company.
- The Company acts solely as a facilitator for the sale and delivery of White Goods from the Dealer to the Winner, and is not a party to the sale contract. The sale will happen directly between the Dealer and the Winner.
- The Company will merely discharge the consideration for such sale of the White Goods for the Winner, and shall not make payments to any party other than the Dealer. Unrelated or third-party payments, sales or deliveries are not permitted or facilitated.
- The Company does not derive revenue from the facilitation of the sale or delivery of the White Goods, and is not engaged in their trade, sale or resale and shall not be held liable for the condition, performance, warranty or any post delivery issues relating to the White Goods.
6. Modification of Terms.
The Company reserves the right to amend these Terms at any time for legal, regulatory or operational reasons. Changes shall be communicated to Users through appropriate communication channels, including but not limited to in-app notifications, email, or updates on the Platform and shall be deemed effective upon notification.
